This is more of curiosity rather than I'll be doing it but I'd like to know.

I currently have an i5 4460, not over clocked or anything just out of the box.

Would it better better to upgrade to a new i5 such as the new i5 7600K or an older i7 that is around the same price?

My only thinking is i7 is most of the time better than the i5 but a new i5 that is coming out in early 2017 could maybe better then an older released i7?

Thank you for any answers or even opinions.

It all depends on what you will do with it. If you are just gaming, you may not need the brand new i7, but the i5 might be fine. If the price difference on the newer CPU is the same or close to the previous generation, get the newer one. No point in paying top price for the older part unless you have some sort of compatibility issue with other parts.

Also, wait a couple days, as the new AMD Ryzen CPU's are coming out and performance tests will be posted comparing to the current Intel chips. It could be a better deal in the long run, and Intel is supposedly cutting some prices. You may want to shop around a bit, because who knows what may come up.

I agree with Guanyu, you don't need to replace the 4460, especially to a 7600k

If you were to upgrade, you'd upgrade to an i7 or Ryzen, as gaming titles are starting to utilise those extra threads.

Yes i only have a GTX 960 so it does the job.
If I upgrade anything it'll definitely be the GPU

Well with the GTX 1080 getting a $100 MSRP price cut next week (according to Nvidia) we'll possibly see a drop in price of the GTX 1070, if that is the case, your money would definitely be better spent there, in my opinion.

IF I were to upgrade that CPU I'd take a look at the octacore Ryzens (wait for benchmarks)

The future is more cores and your current CPU is still pretty potent so upgrading to another quadcore i5 seems like a huge waste of money.

The 4460 is definitely a bit weaker than a 7600k but the gains are by no means worth it to spend >350$ on with a new board and RAM

If you're running a 960 now, upgrade it.
You can get a Rx480 for the same money or less than the 7600k costs
