i have an option between both, be advised neither will cost me anything as i already have a 4790k and i recently bought an old computer for cheap that has that cpu in it (some mother sold it to me for $500 cause her son moved out). anyway, which should i use for gaming? i also do animating and 3d work for my major.

4790K - New architecture , better single core...

If you're only considering gaming performance , there is no considerable difference in gaming from an i7 to and extreme edition. The only upside would be a slightly better perofmance in heavy CPU encoding , video editing , rendering and all that stuff. I'd suggest to save the hassle and go for 4790k.

i already OWN both cpu's though, so what hassle?

4790K - New architecture , better single core performance , higher clock speed , less TDP and runs cool
3960X - 12 hyperthreading cores instead of 8

(hassels are mentioned above)
Your choice.

Futuremark 3D 12 is showing promise for the 1000 dollar processor and most likely the 6/12 Core/threads and 8/16(i7 5960x) Core/threads will see a big improvement in future titles that make use of Direct X12. Check out some benchmarks and the Final Fantasy Cry Demo. (very Cool). Unfortunately this may take a bit of time for Devs to completely adopt to DX12, even now we still Direct 3D9 being used in 2015 releases.
Then there is the older Wellsburg (X79) platform , which does not have the features that Z77 used native like USB 3.0, so there is better value in getting a Z97 /i7 4790k in more ways than gaming performance. One cool feature i like is M.2 Sata right on the Motherboard , also the newer Z97 boards have USB 3.1 . There is a some food thought, .. anything else just ask us here.

EDIT Note. I forgot to mention that as of now with DX11 , as im sure you probably know , the i7 4790k , with it's beastly single core performance is the most likely to beat out the older Sandy Bridge Hex Core out of the box. (Sandy Bridge Can overclock very well)
