Install Windows 10 over unactivated Windows 8

I have windows 8.1 but i apperently can't activate it:s i have tryed everything...so i have now a new purchased "windows 10 home" downloaded on a usb-drive.

Can i instal windows 10 over the unactivaded windows 8.1 and how? Preferbly without deleting my programs??

boot to the USB, follow the prompts. If you want to upgrade, select that option. if you want to wipe out everything(this will delete all your data) and install a clean OS, then select new install, and delete any existing partitions.

But wont give it any problems if windows 8.1 is unactivaded?

Why would it? The install doesn't know it until it tries to activate itself - at which time you just give it the key you purchased.
