i currently have a i7 4770k and i can only seem to be able to get it stable @ 4.2ghz . the i7 4790k is supposed to be a lot better for overclocking . would it be worth it to upgrade from a i7 4770k to a i7 4790k ? and if so should i pre order the i7 4790k ?

Which motherboard do you have? It's rumoured that Devil's Canyon won't be supported on Z87 boards, except on some - possibly with a BIOS update. Which would rule out the 4790k altogether.
The 4790k turbos to 4.4GHz at stock, so that would already be further than you can achieve. IMO if you can sell off your 4770K and not make much of a loss on it and then get a 4790K when it's supported by your board, it might be worth an upgrade. Otherwise, no. Plus we don't even truly know when it's releasing yet - it's supposed to be announced on June 2nd, but could be as late as September. Intel haven't started shipping the products yet.

If you turn on MCE (Multi-Core Enhancement) you can get the full turbo speed on all cores. Devil's Canyon should also overclock further - it seems that you got a 4770k from a bad batch.
But that's some solid reasoning, I agree with your decision. Personally I wouldn't touch delidding but each to their own.

You may want to reference the Toms article comparing CPUs to see how it stacks up from a gaming performance perspective. Of course, if you are a hard-core enthusiast, it's all about the newest toys!

There is no reason to move from 4770k to 4790k...
Yes, there have been improvements to the thermal interface material & some extra capacitors to better handle the heat, but this doesn't magically mean every 4790k will hit higher frequencies than its predecessor. (it still depends on the batch for a good part).
The 4790k simply use more voltage to handle these already high stock frequencies, so this is literally just a factory overclock. (With ofc more heat and TDP).
They are just highly binned 4770k... at least we hope so😉 I don't know why some people had the hope of a big step up.
The best thing for 3770k & 4770k owners is still doing; delid, lap the IHS, and to use CLU as TIM (all at own risk) if done well and with passion, there will be a spectacular temp improvement.
There is no way; some improved TIM and extra capacitors will beat this combination I listed above. (Unless they return to use the solder as on the beast 2700k).
Another thing is if you have to build a whole new computer, then you can begin to think about it, and relative prices.
(and in most cases the Xeon E3 v3 family will be the winning choice @ power/price ratio "if intel does not understand this, in the long term, and raise/fix the prices of the whole thing").

If you go to open your chip (at your own risk) and you do everything perfect, as I said above you will have an improvement in temperatures almost scary, for sure you will be able to go up with frequencies quite a bit more, then for the stability etc. everything will depend once again from your batch.

Not worth it stick with the 4770k . Is there a actual need to get higher ? What are you stressing it with to get those temps ?
