I know the CPU cooler is very over kill but it is money I need to spend on the PC anyway.

EDIT: And I will be running a second XFX Radeon R9 285 2GB later on CrossFireX
 
The biggest problem is putting a high performing I7 CPU on a H 97 motherboard.

For that cost, I would definitely suggest the "K" version CPU and a Z97 motherboard.

The minimum RAM that I would recommend is 1866 CL9 RAM (2133+ is better for similar cost).

And lastly, a GTX 970 is a better buy for that performance range.

Why is having an i7 bad on a H97? I wont be overclocking.

1, I just said the board wasn't going to SLI
2, 280s are about 100$ cheaper than a 970, I don't know what you're talking about, unless you made a typo and meant to say something like the 290...

Once again, you are arguing for the sake of arguing. Lets just leave it at: OP can pick which he wants. Both are good options. I personally recommend the xFX650.
