I was wondering is it okay to upgrade to Windows 10 through Assistive Technologies? and do I have the option of format or is it upgrade only??

There are many ways to get Windows 10. The only legit way is to pay for it, unless you belong to a specific category that Microsoft determines is eligible for reduced cost or free. So if you want to try another method other that full price, feel free to do so, just read the EULA.

Once you have a valid Windows 10 key and a related Microsoft account, you'll be able to do a full reformat, just like any other licensee.

From an ethical standpoint, I would not personally be able to advocate for this. Microsoft left this option open to help people who have real disabilities and can use the latest assistive technology to better enable them to operate their PCs daily. It's not meant for people who either were too lazy to upgrade in the ample timeframe involved or who do not want to spend $90 on the operating system for their PC. Programs similar to this have been ended in the past by Microsoft or other companies because of abuse of this type.

However, it's your conscience and you're the one who has to personally live with your ethics, so it's up to you.

Legal? Yes, but only if you use assistive technologies.
And it is upgrade only. Qualifying OS (win7 or win8.1) is required for the upgrade.
After you have upgraded to windows10, you can perform clean install (with format).
