Is this a malicious file?

I just noticed a new folder in my hard drive, it's called beb09763dd4c96bfc465c1db2f9a97 and it says I need the system's permission to delete, should i be worried about it? If so how do I get rid of it?

It's most likely just a place for temporary files used by some application. You can't delete it because it's still in use by that application. You will most likely be able to delete it next time you reboot. I wouldn't worry about it.

Malicious software would hide the folder, you wouldn't even know it's there...

Those are typically artifacts from Windows Update. They are typically removed automatically about 15 minutes to one hour after the updates have been installed (and validate through a restart). If they aren't removed and the folder is empty you can safely delete them.
