japanese import subaru legacy outback wagon

As the title states i was give a "japanese import subaru legacy outback wagon" however after flushing the rediculuse over fill of tranny fluid i went to put the car in reverse and repark it. Ofcouse "after refilling with the proper amout of tranny fluid..." Inbetween the car having to much and the proper amount of fluid though it wasn't ran and the trannsmition was "still" good according to the person who gave me the car it was a running driving car minus the cv axle need to be replaced. I have been getting mixed comments and trust this site more then most.... Is it likely a dead cv axle will lock the tranny before causing damage to it?

We have a '06 Forester, bought a couple years ago.
Reading many reports online and talking to actual Subaru mechs...those aren't just scare stories. Great cars, but you have to stay within the lines with these.
