Just Cause 3 Unstable with current gen hardware

I was enjoying playing Just Cause 3, but then I started noticing that my framerate would drop form 100 ish to 29 and 30 fps. Also, after about 1 minute of gameplay, my game crashes with a Direct 3d error, error 38 to be exact. I looked around and found that if I used MSI Afterburner and underclocked my GPU by a value of -7, it was stable and free from the error 38 for about an hour, however the normal framerates where reduced to 70-60, then dropped to the sub-30s. This just started and I have played about 11 hours before this problem

PC Specs:
AMD Ryzen 5 1600 (@ 3.8 ghz)
MSI GTX 1060 6gb (stock)
16 Gb (2x 8gb) T-Force Night Hawk @ 3200

Update: the temps are a stable 64 before and drop to 25 ish after the window closes, even on a crash. I fixed the frame cap problem by enabling free sync, but the crashes still persist. I have checked and updated my nvidia drivers to the newest and it still crashes. Thanks
