Memory issue - 1 stick works,other does not - RMA did not find erros

Hi

Thank you for your expert knowledge to anyone that awnsers. I've got a weird situation with my RAM sticks (A dual channel kit).

I've purchased 2 memory sticks from OCZ (says Dual Channel Kit so I guess they are paired). The memory is x2 2gb PC3-10666 with a latency of 9-9-9-26 and 1.7V, and one of the sticks shows bad bits in memtest86+, I've done some tests with juts one stick, the bad one shows errors when placed in any of the 4 slots on the motherboard, while the other stick shows error free passes on all slots of the motherboard, so I thought this was clearly a memory issue with one of the sticks, but the computer store says otherwise, here are just screenshots of my tests with errors:

Now the problem is that I've sent them in for checks/replacement (?) and the store checked them and said they passed their tests in MemTest86+. They said that these MemTest86+ results are not enough and that it would be an incompatibility with my motherboard. The system is not overclocked and the motherboard spec. says that it will work with PC3-10666. So I'm wondering, how could it be possible that my tests clearly show errors with one of the sticks, but not the other, when they are paired for a dual-channel kit, and the store could not find any issue?, how can I argue against their error free tests? Or am I just doing something wrong and the motherboard could be incompatible with one of the sticks?.

I do not have another motherboard to test the sticks in, though I will probably get new RAM before sending these in for RMA.

The motherboard is an ASUS M4A785TD-M EVO, on the ASUS, in the memory compatibility list for the motherboard they mention 2 OCZ memory sticks (product number OCZ3P13334GK and OCZ3P13334GK), those are both with a latency of 7-7-7-20 so my memory is not listed, mine is OCZ3G13334GK with a latency of 9-9-9-20. But I think it is strange that only one stick works, if there was an incompatibility then I assume that both sticks either would work or not work.

Thanks for the replies, I read up more on my rights as a consumer ( I live in Sweden ), and I do have the right to get them replaced at least.

I was just asking here to be sure that I am not missing something or doing something wrong. Of it such an incompatibility is possible.

I will get the sticks replaced in one way of another.

I should also add that I did not purchase them from OCZ, in my first post "I've purchased 2 memory sticks from OCZ " I meant that they are branded as OCZ, I can now not delete or edit this thread.
