Mouse unfixable in Windows 7

Hi, I have had a problem with my new rig since I got it 3 weeks ago. It is to do with the mouse. The mouse is a Gigabyte M6980X gaming mouse. The problems are these:

1/3 clicks register.
Cant drag files or windows at all.

Have tries updating windows, drivers, and have done a fresh install of Win 7 Pro x64.

What can be done to fix this?

Sounds like a defective mouse.

After messing around with cables, I think its actually the ESC key stuck down on the keyboard (which is causing problems with the mouse) Is there anything I can do?

Also, here are some other things that happen:

Games pause themselves
Right click menus close themselves
Start menu closes itself
Loading pages are interuupted

(All of these are to do with the ESC key
