Msi gtx 970 low fps

I recently purchased a msi gtx970. At first I had bad audio issues through the hdmi audio but that was a huge deal for me because I use a headset. But now I'm have bad fps issue every game I play is getting about 15-20 fps regardless of video settings. I have installed and uninstalled the drivers 3 times and nothing seems to help. I ran a 3dmark to see what I was getting as a score I ran it 4 times and got scores between 4100 and 4300. Temp doesn't seem to be and issue as the cpu never gets above 40c and the gpu never gets above 70c

Intel 4770k
Corsair h60
4x4gb Kingston 1866 memory
2 Intel 240gb ssd in raid 0
Msi gtx970 4g
