my cpu runs hotter while idle

I recently had received a used AMD 8350 Black EditionI installed it onto my motherboard and loaded windows 8 on to a new hard drive I have a GTX 970 as well. I opened up World of Warcraft and started downloading World of Warcraft and my computer temperature shot up to over 70 degrees Celsius in my motherboard computer shut off. I started World of Warcraft and was playing World of Warcraft and my CPU temperature stayed around 40 to 50 degrees Celsius. the CPU basically runs hotter while the downloader is running and also while its idling is around 40 degrees Celsius. do I have a bad CPU that has just been overclocked for too long?
 
I have a sabertooth 990fx r2.0 mobo as well as the software that has the thermal monitor. I watch my cpu temp while the game is running and it stays around 45-52°C however when only the downloader is running my temps skyrocket Reaching the shutoff point. I asked another tech and he thinks the cpu was overclocked hard and can't run the downloader without overheating because the downloader utilizes more threads. Does this seem possible?
 
Dont bask in intellectual victory just yet slick. I figured out the processor was the issue it has a bad core thanks for nothing tho guy. Trolls do what trolls do I guess. Enjoy living life alone trolling forums and blogs lol
