New Motherboard - Windows 10

When I first purchased my PC I let my cousin build it for me, he claimed to be the god of pc knowledge when it came to computers, so I let him build one. I then learned quite a bit about pc's and realized he doesn't know shit. Long story short, he built me a pretty crappy computer. Along with the pos was an "OEM" version of windows 7. I had windows 7 for a couple of years, then windows 10 popped up for me to upgrade, so I did. I now have windows 10, everything is fine.

My motherboard only has sata 3.0 and I'm wanting to buy an ssd, so I'll need a motherboard with sata 6.0.

So if I upgrade my motherboard, will I still be able to use my current Windows 10? Does it matter that the previous windows 7 was an oem version? Another reason for upgrading my motherboard is because my r9 390 is huge and blocks some of my other pci slots.
 
Solution
If you go strictly by the eula then no. But if you contact microsoft and ask they sometimes(not always) show leniency and will let you move it.
