new system overclocking failed without any overclocking??

I've just build a new system and on startup I got this message: overcloking failed hit F1 etc...
But I havent tried any overclocking......
After installing widows 8.1 the first time everything looks fine.
I downloaded my nvidia drivers for MSI 970 ME and on restart no more mouse pointer...
and this failed overclocking problem....
I've formated my HD, re-installed video card driver, same problem.... but with or without the card driver i get the failed overclock problem....

CPU i7 5820k
Cpu cooler h100i
Mobo asus x99 pro 3.1
video msi 970 million edition
memory 16gb (4x4)g skills ripjaw 4 ddr4 3000 (pc4 24000) F4-3000c15q
HD Samsung 850 evo SSD 500gb
 
You can get this sometimes with bad RAM speed/timings. Happens on the AMD side as well.

Go into BIOS and make sure you're using the right XMP profile if available. Then run memtest for 2-3 passes. If you get no errors then the RAM is OK and could be the CPU isn't seated well.

I didint change anything in the bios I wanted to isntall everything first.
I have 2 choices in xmp profiles in ezmode, I put it at disable but after every restart it goas back to profile number 1

no other choices in ezmode, in advance mode I got plenty options but I'm a newb with this!
In Ai overclock tuner it is set to xmp (auto and manual are other options)
I ses that my processor core ratio limit is at 29??? I didn't touch anything but I'm pretty sure it was higher the first time I entered the bios...
Now my 5820 frequency is 2900mhz (supposed to be 33000mhz!?)

my motherboard seems to go to the xmp profile #1 even when I disable it.
I guess that I'll need to oc the cpu.... never did that...
where should I start?
