open case on gateway

have a gateway dx4870 trying to remove the case took off the 6 screws and side panel how do you remove other side which is attached to the top

You can't, it is non removable. Only the side panel can be removed.
Even if you remove the plastic, all the metal sides are soldered together.

I know that is the case with the dx4860 but this looks like it can be removed. my issue is I had a cd break in the cd drive I tried the paperclip trick to open it but no luck was hoping to replace? it

To replace the optical drive you need to remove the from plastic cover.
If you look inside your case, you will see that the front panel is held in place by tabs (on the sides and bottom).
There are 3 tabs on the side you opened, there is 1 tab at the bottom, 3 tabs on the other side that you might not be able to easily see them and there are 3 tabs on top. You need to press these tabs carefully to remove the from panel.
But first you might need to remove the drive cage (one screw on the side), disconnecting all cables attached to it.
Some of the cables are held by a white plastic piece.
I was installing a fan controller on a drive bay and I had to remove the GPU and the CPU heatsink.
I think Gateway did not want anyone messing with the front panel.
