It's just the internal storage that you can only use to save legal games, there is no reason for nintendo to not allow this.

It was a very dumb decision for Nintendo to opt for pricey and unreliable SD cards for internal storage. I believe they did that to save power, but I mean they could have installed a beefier battery and help their customer safe money and reduce the risk of storage failure. The latter is a bigger concern.
