Might just be stuck from shipping. Get a thin paper clip and stretch it out and use one end to push in to the little hole near the button. That will force the tray out, slip it back in place, and try ejecting it with the button as normal. If that doesn't work try ejecting it from within windows, go in to computer, right click the drive and choose eject. If none of these work, you have a DOA drive and return it for a working one.
