Hmm, the merged install patch 3.04 seems to be down for the moment,
standalone is ok.

If you have trouble getting the merged from the above, you can grab it at
ftp://209.163.147.67/FB_AEP_PF_Merged-304m/

I am downloading now, won't be messing with it until probably tomorrow
evening.

I be tired tonight!!

I don't think so. From what I have seen, the next patch will be a big one,
and will have some of the additions being talked about.

Not much. Where are the promised new aeroplanes? In the pocket
of the American lawyers? Shame!?

Don't dare say anything on SimHQ, either, that does not resemble a)a
screenshot, b)gushing about the screenshot, or c)gushing about the
patch.

Just gets more and more limp-wristed over there. Recently, I went over
to Frugal's and read like six pages of the Free Falcon boys being
trashed over the CobraOne Falcon release. Now *that's* two-fisted
flight-sim entertainment, not the momma's boy, lickspittle syncophantic
threads that SimHQ 99% consists of.

He didn't say Americans; he said American lawyers. He's referring to
the whole IP issue with American companies that manufactured U.S. WWII
aircraft and their claim that flight sims are illegally using their
intellectual property by making 3d replicas for sale in games. They
already had a go at modelling companies on the same issue. Now it's
the software industry's turn to be leaned on. So Oleg has said no new
American planes because he doesn't want to get into the whole issue of
paying royalties for 3D models of US planes.

I think that what he may be referring too is the missing Betty bomber that
was advertised on the box and which 1C stated was done but not included
because of not enough room on the final CD (their excuse).

1C is playing the blame game with UBI on this one and the supposedly
finished bomber has yet to materialize (big surprise). My take is that it
was never finished in the first place and that there was some fibbing being
done for PR proposes.

And that would be the American lawyers fault and not the companies, right?

BTW, have you read any of the postings on this? I've posted links several
times in this newsgroup to the ubisoft forum and the developer's forum. The
manufacturer's rep that is contacting the software companies isn't even a
lawyer.

It would also be much more helpful to know how much they are asking in
licensing fees. In order to protect their rights, they need to charge
something, it doesn't have to be much. I'm not going to bother explaining
it all again here, as I've already done so on at least two occassions.

I will admit, I've wound up outside the local Lockheed and Northrup offices
by coincidence (visiting other people with offices in the same building) and
have been tempted to poke my head in and tease them about their pestering
what amounts to toy planes. But it's not their fault.

Lastly, when did Oleg announce no US planes? Last I checked the forums (a
while back, I'm rebuilding my living room and so don't have much time for
the computer) he was silent on the issue.

And it's not a royalty (which involves a percentage on sales) it's a
licensing fee for the use of the name and image and other companies have
been paying it, including Microsoft paying Cessna.

Jay, I've read about this ad naseum on ubi, simhq, frugals and at the
idga forum.

My post was to correct those who thought blaming "American lawyers"
was a blanket statement blaming Americans. I didn't say I blamed
anyone, just trying to fill in some facts for those who didn't appear
to be aquainted with the issue or what the original poster was hinting
at.

>And it's not a royalty (which involves a percentage on sales) it's a

You're right; it's licensing fees, not royalties. Some licensing fees
are based on projected sales, though (I think I read somewhere 1.5% of
ps). But there's a big difference between paying licensing fees to
represent aircraft built over fifty years ago and paid for by public
taxes and a Cessna.

Regardless, Northrop apparently got Ubi to pay. Ubi then apparently
deducted some or all of these fees from the developer. Not
surprisingly, Maddox , quoted at simhq forums back in Dec. said, "As
it is known already for public by the leaked somewhere info, currently
we will not develop or accept from third party any planes owned by
Nothrop (Grumman, Vough, Republic). Even the one that we did already
for free add-on."

I suppose they may appear in a later add-on, but I can't imagine that
it will be free.

A note for TIR2 users. Make sure you have the latest drivers for it or you
will only have mouse emulation, not enhanced mode.
