[SOLVED] Rtx 2070 Odd power settings issue

I recently got a Rtx 2070 from gigabyte. The base clock is 1410mhz and boost i have seen as high as 1890mhz. My issue is when it comes to power settings. When i go into nvidia control panel and tell it to prefer max performance as well as go into windows power plan settings and set the pci express power save state to off. It acts as if all of those are on. The clock stays locked at 1410mhz for the most part and the temps stay low. It acts like power saver is on for both things. But then i can change the pci express power save function to maximum power savings. Tell nvidia control panel to either be adaptive or power save and restart my pc. Then the gpu heats up and the clocks progress all the way up to 1890mhz as if the gpu is actually on high performance mode. So it may be that my mobo is too old and its causing something funky idk. but its acting like the exact opposite of whatever i set it as. Although when its on power saver and the higher clocks it still seems gimped in performance in some ways as well as on performance mode.

Motherboard: Gigabyte Z97x-UD5H-BK (Rev 1.1)
Cpu: Intel core I7 4790k 4.4ghz
Gpu: Gigabite Rtx 2070 Windforce 8G (Rev 3.0), 2x windforce fans. (Gv-N2070WF2-8GD)
Ram: Corsair Vengeance pro 1866mhz 32GB (CMY16GX3M2A1866C9
Storage: Samsung SSd 840 EVO 250gb
Toshiba DT01ACA200 2Tb

oh right completely forgot about psu my bad. Its a Cooler master m2 silent pro 1000w. And the temps seem normal i think.
Cpu Temps: Idle 27c
Load 51c

Gpu Temps: Idle 45-48c
Load 60-78c

And yes i check gigabytes page from time to time and they have given up giving updates for my mobo because as far as i know the latest bios and what i currently have is the F8 version. And windows should be up to date on everything. i had reset my pc and freshly installed windows not too long before getting the new card.

no other pc to try it in. I dont think its a card issue maybe. because its brand new. it just seems to do the opposite of the windows and nvidia settings.
