Listen if it weren't for the iPhone then smartphones today would suck and clearly we wouldn't be having this 'debate.' Clearly some of you haven't seen or read Samsung's own internal communication (email) shown in court stating Samsung knew they were infringing on Apple's patents. That's what put the nail in the coffin.
Apple's real target is Google for ripping-off its UI all the way down to its Store (environment). Possibly that's going to be the next major litigation, or Apple may pick-off one company at a time. Reminiscent back to the days of Microsoft (Jobs v Gates).
Patents - you wouldn't want a World without them, no one would spend a nickle in R&D. Patents allow for Licensing and if Samsung paid for licensing ditto we wouldn't be having this 'debate.' No patents no, little, or slow innovation.
Hypothetical example imagine your company considered spending a billion coming-up for the cure for (e.g. AIDS, Autism, etc) but you knew day #2 another company would simply copy and sell your same curing (formula) medication -- the cure would never be found because no one would waste a billion in capital.
So rather than snarky remarks with no basis, think about what you're actually saying and put yourself in each companies shoes and in the process gaining some perspective. If you owned Apple you'd protect your profits, if you owned Samsung you'd cheat or steal to make a buck; real World.
