Samsung SSD 830 fail to benchmark

Hi guys.
I recently got Samsung SSD 830 256 GB and I try to installing on my desktop with P6X58D Premium. After one week to testing most of possible solutions, It still keep failing the magician benchmark, crystaldiskmark and as ssd benchmark. I did secure erase on samsung magician too.I tested on both Marvell and Intel SATA ports. Currently on Intel SATA 2 port.
So I'm wondering maybe it is the drive's fault and need to RMA?

Suggest to run diagnostic on the drive. if by chance not it doesn't have any error you can't RMA it. but if does go ahead and RMA it. it will probably solve your problem by getting a new SSD.

btw. also make sure that the benchmark your are using is compatible with an SSD drive.

I run the diagnostic and it show a few error. I plan to RMA it. Thanks for you help.
