Your router might support QoS (Quality of Service). But you, your brother, and your parents (they're paying the bill) have to sit down and define the rules.

Setup home network. Right now you and bro are fighting for bandwidth, in direct competition. Via network you'll share instead.

We are on the fastest package they offer "Faster Fibre" why is my brothers pc using so much bandwidth?
This has happened in teh past resolved itself and now it's back

Because it (your brother' PC) can. For that PC to consume 40Mbps means it's constantly downloading something. Configure the downloader to run slower.

Again - this is something to be resolved socially, there're very few technical means available.

It even slows down when he hasn't signed in though

For what I know, downloaders (torrent clients) can run in background, too. If he is not signed - just shutdown his PC.

Again (final) - resolve this between yourselves. My house survived couple of years with two teenagers on 3Mbps DSL line, and no one got killed.

Take a look at his network monitor and see what's using the internet.

Log into the router. See if there is a traffic monitor.
