My question
I found out that my 4090 only runs on x16 3.0. I messed around in the bios and even updated it but it stays on x16 3.0 in gpu-z. Could it be because of my nvme 4.0 ssds? I have 3 in there, 1 on the CPU lane and 2 on the chipsets.

When you run Gpu-z are you running the little video test? On first page go to bus interface info line. There you will see a question mark. Click on that and run the little render test. See if it changes the info. Sometimes it does not report the correct info until you run that.

Yes when doing nothing it stays on x16 1.1 when doing the test it goes to x16 3.0

I know you want the most performance from the 4090. Good news is scalability on the 4090 shows pci express 3.0 doesn't hinder performance. On the other hand, I assume you've cleared the bios? Did you do a clean uninstall of the display driver from the prior card?

Oh dang!!!!! good find. Is there a bios update? Have you opened a case with Asus? Usually mobo manufacturers won't do a thing about this until enough people complain.
already have the latest one. i will propably wait this out . It eases my mind now that i encounter more peoples with the same problem
