Warranty Sapphire and Visiontek?

I am looking at buying a $60 Visiontek or $63 Sapphire 5670 board. The Visiontek is a refurb.

-I read a post here that said Sapphire charges $40 for administrative fee's for warranty problems. Is that true?
-Even with the refurb Visiontek has a 3 year warranty, anybody tried to use it?
