Weird FPS drop and stuttering (hd 6850)

I recently started playing devil may cry (the latest one) and even with the graphics set to high instead of ultra and hd textures, shados and AA turned of but I am experiencing severe fps drops and massive stuttering form time to time. Any ideas on what might be causing it?
My specs are:intel core i5 2400 3.1 ghz
asus radeon hd 6850 v2(it has 2 6-pin power connectors)
8gb ram 1600mhz (g.skill sniper)
gigabyte p67a-ud3p-b3
hdd 500gb wd caviar blue
spu sentey solid power 550w (sdp550-ss)
 
Is there any frame difference between low and ultra?
If not this could be a possible CPU issue, but the 2400 should handle most games exceptionally well. If the frame rate does change it is most likely the graphics card, being a generation old. That or wait and see if drivers for the card fix the issue. This is the case with most new games on release.
 
I forgo to add that I checked for gameplays on youtube and this card should give me 60+ FPS with everything turned on and in ultra. Something I just tried was to set the gpu clocks to default (they where slightly overclocked but just a little and the temperature was only 56º) and now I have a more fluid gameplay with less stuttering which leads me to the question: why would my card give less fps with overclocking???? Could it be flawed?
