Western digital recertified RMA

Hi, about 3 years ago I had a Western Digital caviar black fail approx. 2 years into the warranty. I RMA'd it, which at the time was an easy process. However, I've since come to learn that they sent me back a 'recertified' drive, which is now failing as well. Ideally I'd like to RMA this aswell, as they're expensive (for me) to replace. Normal black drives have a 5 year warranty (which I thought I'd got again with the RMA) but apparently recertified drive warranties are 6 MONTHS! Do I have a leg to stand on here with an RMA case, in terms of consumer rights etc etc, or not at all?

I don't think you get a new 5 year warranty on a replacement drive, if anything you would have the balance of the 5 year original warranty that you can argue against. Otherwise you can end up with buying one drive but keep getting new ones and having an unlimited warranty on them, which I'm sure they can't support.
