what brand of gtx 970 should i chose i dont have evga brand in my country and i have i5 4440 will it bottleneck this gpu should i upgrade the cpu to the xeon e3 1221v3

It should not bottleneck and you should definitely get the ASUS STRIX model. It has a 0db function and will stay dead silent until a certain temp is reached. Like you can play light games like league of legends with that function. It also has a decent size not too big. so i would go with asus

I had a 970 from EVGA on a i5 4440k and worked great.

No reason to upgrade the CPU, the one you have is very good for gaming. As for the GPU i'd go with either the Asus, MSI, or Gigabyte (aftermarket coolers of course) what ever one you can get the cheapest.

I have the Asus Strix model and that thing runs very cool at both idle and load. Also the build quality is very good, the whole thing is made out of metal, no cheap plastic only on connectors, fans and parts that require it. In reality any one of MSI, Gigabyte or Asus will get you the job done, just get the cheapest one of the three.
