Your problem is the cooler, it's just not a good design, barely adequate but some things could be done to help it out:
Whatever case it's installed in the air must FLOW-usually in at the front/side and out at the top/back, it's better to have more in than out, excess pressure simply assists the exhaust fan/s and helps to keep dust out (assuming the intake fans have dust filters).
If you have a bottom mounted PSU, invert it, that way it can pull warm air out of the dead...

hmm that is HOT! can I ask when the last time you cleaned the fan? How many cooling fans do you have? you could simply up the Fan RPM in the software control for that GPU if you haven't already done so.

To reduce this you could add more cooling fans (definitely a side intake which is sucking cool air at the GPU).

Temps are are a bit on the hot side - however, gpus are designed to run temps around 95+ degrees, you shouldn't worry about it until it reaches around 90+ degrees constantly. Maybe you could give you gpu a good dusting and reapply the thermal paste.

I never put any thermal paste on when i got it,should i of done that? I just took it out of box and put it in.how would i clean the dust out of it,it looks clean as is,its only 2 weeks old,the whole rig is

Well if it is only 2 weeks old i guess it doesnt need cleaning at all. Also no you don't need to reapply the thermal paste forget i said that as your card is still new. The temps are nothing to worry about as it has not even reached 90+ degrees celsius just enjoy your new graphics card. The temps are probably common the vtx3d card you have.

After a week of owning the card BF3 was running at 96C for 2 days,since them 2 days its around 86C now for most games and i believe if i didnt turn metro off it would of exceeded 90C

I already sent 1 back because the mem on card corrupted,i cant go through another 10 day wait,they take the piss,i will ring them monday though

This website makes me laugh sometimes,everyone posts answers then after about 10-15 mins not 1 answer or reply or post,its just forgotten,is that normal here? I am asking for any help.if you dont know say you dont know,thanks

Not sure how the Distance Selling Regulations apply here but if the card was replaced within 7 days you might be able to return it for a refund under those regulations.
Scan are usually a helpful bunch, maybe, if you're nice, they'll swap it for something with a better cooler.
