which one is better ?
( 45% Gaming, 35% Video/Photo Editing, 20% Daily Use )
i3-7350k or i5-6400 ???
both of them have a similar price in my place...

On April 11 AMD will release 4 new CPU's, Ryzen 5.
For the price of 189$ you can get Ryzen 5 1500x that have 4 cores/8 threads what is same as i7 or for 169$ R5 1400 with same 4c/8T.
That should give you same productivity performance of i7 for the price of i5.
So if you can wait i suggest you to wait until then and buy one of those. You will get much more performance for same or less money.

determined by the new Core i3 7350k's decently high stock clock speed and its ability to overclock(notice the K) i would recommend that you go for that as its lower wattage and more performance to the dollar as the 7350k runs at 60w and the i5 6400 at 91w. One of the main advantages of the i5 6400 is that it has 4 physical cores compared to the i3 7350k having 2 real cores and the same 4 threads as the i3 7350k. So, if you are going to be using lots of programs at once, id go for the i5 but if you want solid single program performance i would choose the i3 due to its several advantages over the i5

Which i5-6400 runs on 91W???

For gaming I'd probably pick the i3 overall. Both come with their limits - the i3 got the clocks but only 2 physic cores while the i5 has 4 physical cores but is clocked a bit too low sometimes. So generally the i3 should do better in games that don't tax all 4 cores.

For video editing cores beat everything else and the i5 will outperform the i3.

My suggestion is to either wait for Ryzen or save up 15$ more and go for the i5-6500
