Question Why cant I sign out of my apple id when it's locked?

I have a phone, where the apple id has been locked, the person that set it up has gone somewhere, so I don't know the security questions nor his Gmail. I've tried going on to the apple website to remove it but it kept asking to unlock my apple id.

That's exactly the situation why they have created this iCloud lock. It's so that someone else can't set the phone to factory default settings.

Either contact the person or Removed. Apple is also not going to help you with this, unless the phone's serial number is connected to your personal iCloud account/AppleID.
