why does my hdd easily peak at 100, especially with "system" windows 8.1

I recently built my pc
amd fx9590 with liquid cooling kit
asus m5a99fx pro r2.0

I keep experiencing freezes where the image is there but my keyboard and mouse are frozen. It usually happens when I am running a game and within 30 minutes of playing it freezes and on high demanding games it only takes a few minutes or on a load screen from a save on games like inquisition, also it happens when I try to download a game while watching videos, or it will simply freeze in about an hour or longer when all I'm doing is using Hulu.
I believed I had a bad hdd because it will easily peak at 100% especially when I load an application, I tried checking the ram but it works fine, i haven't had any blue screens, and the cpu is also running fine at decent temperature rate of 50 Celsius. everything else Is also running at a good temp.
But when I check it in the task manager it says "system" is utilizing 95% of the Disk, which on average is 35-40 mb/s and if it isn't the system its something else using utilizing so much mb
So my question is, what is it the keeps freezing my computer, is my os messed up, or is my hdd messed up, or could it be an entirely different thing

It may be a good idea to start with backing up the most important data that is on the drive until you resolve the issue.
Apart from that, it will be a good idea to test the HDD with a brand specific testing software. The results will show you the overall health status of the drive.
