Win10 Upgrade or Install? What if hard drive goes bad?

By upgrading to Win10 do they mean upgrade like update or do they mean wipe Win7/8 to install upgrade? What happens if my hard drive goes bad and I had to reinstall Win7/8, will I still get the chance to redownload Win10 even if the 1 year free upgrade already expired? Sorry for nooby questions, I've read some articles about Win10 brain couldn't process anything so I didn't fully understand wth I was reading.
