Windows 8.1 without activation Can i upgrade it to a new bougth windows 10 without losing files??
 
Solution
nope not legally...and to request help allowing you to is a violation of the TOS for tom's. Get an activated copy and then people can help. With an activated copy it is possible to upgrade without file loss though I encourage you to back them up regardless in case things go wrong.

Solution
You need to keep your files backed up all the time, regardless of whether or not you are upgrading the OS.

From your post I'm guessing you haven't bothered keeping backups at all, and that's just plain silly.
What are you gonna do when the hard drive dies?
Are you gonna pay a data recovery expert a week's wages to get your data back?

no truer words about data have been spoken. I have two copies of everything on my different drive pools on my server, minimum.
 
This is just not true.
You can upgrade non activated win8.1, resulting win10 will be not activated.
Since OP has win10 license, it can be entered after upgrade and windows will activate.

absolutely correct. I miss read his post because of a typo and only spotted it after you replied. Yes if you have a fresh new copy of windows 10 (not an upgrade version) then yes you can do as you asked no problems though I still encourage you to back up regardless.
