Windows OS For Gaming Pc

I'm building a new gaming pc and I'm a bit of a dilemma here.
The first thing I want to address is what OS to use. I have used windows 8 and I liked it and it worked fine for me. I have heard a bunch of bad things about Windows 10, but I installed it on my laptop and I enjoyed it a lot except I did encounter some bugs like the app icons constantly refreshing themselves. What do you think is the best OS for a gaming pc 7, 8, or 10? If you could include reasons for your choice that would be greatly appreciated.
The second thing I want to address is the question of buying OEM or the retails versions of Windows. Every website I click on says something different like illegal or loop hole. It is significantly cheaper to buy an OEM off ebay or something, but I don't want to run into problems down the line. Which should I buy and why?

You could put 8.1 on now and then take advantage of your 10 upgrade later once everything is patched more.

Go with Windows 10 and save yourself the trouble of having to upgrade later. I've had no problems gaming on Windows 10 so far, and this is after I updated from Windows 7.

As stated by kawininjazx, you can stick with Win 8.1 for now and wait for Win 10 patches. As long as your PC has Win 7 or Win 8 installed you have until I believe July 28th 2016 to upgrade to Win 10 for free. After that if you want Win 10 you will have to buy it.

Be aware that DirectX 12 is exclusive to Win 10. But since there are no DX12 games out yet, then it is not a big deal.

I prefer paying extra for retail since I can use it at will to reinstall Windows whenever I want.

OEM versions are locked to the motherboard so if you want to upgrade your motherboard or you simply want to install it to a new desktop you are building, then you need to contact Microsoft to release the product key so that you can re-install Windows. It is a bit inconvenient, if people want to keep total cost down to a minimum, then buying OEM is the way to go.

I just pay the extra $50 or whatever the price difference is so I don't have to be bothered with asking MS to release the product key.
