Okay, So I just upgraded from my old EVGA 560 to this XFX Double D 7970 and I have not gotten any inprovment in my gaming FPS in fact I think I'm getting a few frames less then before, I've done a clean intall of windows and reinstalled the driver but I can't even maintain 60 fps in minecraft anymore which is really bothersome. Does anyone have any suggestions on what I could try?

What games (apart from Minecraft) are you having trouble in? What are your temperatures while gaming like? I don't really know much about the Xeon chips, but that seems like a rather old one which might be bottle-necking the power of the 7970 a tad. Games don't tend to be optimized well for 8 cores.

Crysis 3 - Which I hought was multi core optimized?
Skyrim - only getting like 20 ish fps
Dead Space 3 - 30 fps
Asassins Creed 3 - 18-25 fps
I'm not sure how to monitor in game temps ~

You can use GPU-Z to log temperatures to a file, or what I tend to do is tab out and check the temperatures on MSI Afterburner quickly after a gaming session. The Double Ds (unfortunately, as I also own one) are infamously bad for having bad cooling and high noise. What resolution are you gaming at? Have you tried any synthetic benchmarks (3dMark/Heaven?). This is a complete stab in the dark but what power supply are you using?

temps during the benchmark were at like 79 C at their peak, and the powersupply is some Dell branded 1000w PSU

That surely is weird. What I would suggest would be to try a different power supply and see if it improves. We, computer enthusiasts have always bought components what are considered the best and I am not sure where the Dell PSU comes from. Grab a different one from Corsair, XFX, Seasonic, PCPC and try it on.

Also those frames aren't too far off considering that you ran them on Extreme level. They would improve if you run on lower settings without 8xAA and such. So what you are seeing is actually what your GPU was able to push.

Well the thing is I dont really care about my benchmark fps... its my in game fps, thats where my GPU isnt showing what its supposed to I think its just not pushing its self while in game like it should ~ and I dont exactly have to money atm to put into another server grade 1000w psu :/ this board takes up a 24 pin and a 20 pin I believe to deliever power ~

That tough man. How old is your card? I would suggest contacting XFX if you really think it's the card and have them replace it since DD cards have a lifetime warranty.
