Zalman cnps9700 problems, want to use new PC :(

Hello, I am installing a Zalman CNPS9700, and I have it all set up in the socket, etc. The fan is too close to the heatsink and when I move it with my hands, it brushes the heatsink, and obviously wouldn't work if I turned the computer on.

Does anyone have an idea on what I should do? It doesn't look bent or anything, and I hope this is the right section.

Does it only brush the heatsink in one area? If it is a new cooler then it might be best to send it back to the supplier for a replacement. Can't you use your stock cooler in the meantime?
