power on maximum was always had my cpu working on 4Ghz

Dude im pretty damn sure its an overheating problem and most likely it come from your cpu fan not being installed corectly or it doesnt have thermal grease please check it out and inform me

Thank you one thing i noticed is no matter what settings i choose i get kindo of the same framerate so low graphics lets say they give me 48 fps then medium graphics give me again 48 (the framerate is jumpy tho) high settings again average 48
