I have a system based upon a i5 8400, 16 DDR 4 (2133 mhtz), Asus GTX 1060 dual 6GB, 600 Watt PSU and evo 970 plus 1TB with Noctua NS-D15 cooling the CPU.

But a new game like Modern Warfare 2019, I have had several issues. For instance the game stutters at the the logo at startup (and in some missions) like the London terror attack mission the just halts stutters (meaning it like the freezes for 1-2 sec).

CPU on all cores is 50 - 70 %, but some times it throttles to 100 %. While the graphic card goes down from 99% use to usage in its 60-70 %.

GPU temp during game is between 68 - 72 c.
CPU temp during game 53 - 56 c (thanks to noctua I guess).

So why could the game be trying to push the load from the graphics card to the CPU? Any thoughts?

Game runs at default.

Well its never a good sign seeing your CPU usage being so high. It usually means that its about run its course and needs to be replaced. Check out the video below. He has pretty much the same specs you have, and you can see the CPU usage often spike to 90%. In the comment section you will see plenty of other people saying they have the same problem with this CPU negatively affecting performance. The more CPU intensive the game, the better the CPU needs be to have a smooth experience. COD: Modern Warfare might be one of those types of games.

Funny thing I don't even OC. It's runs a Asus Z370-p motherboard.

How long before the CPU dies do you think? It's from August 2018.

So what should I go with i7 9700k or 9900k? MB can handle both. And can I keep my PSU? Since I don't oc ?

I always tell people to buy whatever you are willing to pay for. The CPU is the true limiter of overall performance, so never settle for less than you can afford. According to the benchmark linked below there is very little difference between these two CPU's, except the 9900K has more threads and a much faster 64 core count.
