How about lobbying to get the system fixed?

And maybe not being part of the problem with H.264?

Given that the patent system was not supposed to inhibit the progress of tech and new ideas they have a lifespan of 14 to 20 years. This was conceived when technology moved at a much slower pace. To modernize for tech patents the lifespan should be 1 to 2 years. Given that everything evolves so quickly otherwise they get in the way of progress.

Also for tech patents they should have random panels of nerds to decide whether something actually is new and innovative or something that is already around. It seems a lot of patents get awarded on designs or interfaces that have been around for years or even decades.
 
When Walt Mossberg pointed out that Apple isn't just suing people but also getting sued, Tim Cook said that was different.
Cos stealing the GUI from Xerox, lifting the Apple logo from the Beatles, ripping off the iPod menu system from Creative, boosting the iPhone name from Cisco and generally being sneaky in attempting to thieve the ITV name from Independant Television is just ... y'know ... different

So says the CEO of the PITA company that started the patent wars...if he doesn't like what Steve Jobs started, stop it and try innovating instead.

And how is suing Samsung for the shape of their Galaxy device and the Home button shape (???!??) that runs a totally different OS defending their own designs? That'd be like MB suing Lexus for copying their taillight design. People don't care. Make the innards better and people will buy your widget!

That would completely wipe out R&D in the pharmaceutical industry.

When a new drug is developed, you have to patent it quickly. But clinical trials, which are necessary before the drug can be sold, take nearly 10 years to complete, and even getting to the clinical trials takes years. So what's the point of a patent that only lasts 1 or 2 years then?

As back_by_demand said, the whole Apple desktop was stolen from Xerox PARC (Palo Alto Research Center).
