Can I sell an OEM motherboard?

I don't think you need to advertise it specifically as OEM, but do include that link in any advert. It can be used just like any other motherboard, but as an OEM part it may have 'quirks' (e.g. there was one thread not so long ago where a OEM board like that was found to have non-standard USB headers).

The main thing here is that it's OEM in the sense that it's a custom part, rather than an OEM version of a retail part - there's no 'Orchid-S' that you can buy in a retail box.

If you provide the maximum amount of information that's reasonable then after that it's just buyer beware. There's no reason someone couldn't build a system themselves out of that board. The main thing is the physical form factor is standard (uATX).
