mine keeps saying put in play cd and click retry but it just wont fire up and i have a legall copy

The files might be bad on the disk. You are allowed to download a virtual copy of the CD so long as you own one if I am correct. Just not CD keys.

Also, Blizzard has this nifty feature where you input your legit CD key into their website, and they allow you to download virtual clients for their games.
