my gigabyte ga-970a-ud3p came without shrink wrap or a sticker seal on the box. Everything inside was packaged though.

I'm guessing Amazon sold you an Open Box as new since all the accessories were included. You're likely ok to keep it as unless you videotaped opening the package and finding the motherboard box as it was, you cannot prove you received it in that condition. Since all the other components are there and in their original packaging, you should be ok.

there is a slight damage to the static bag and the box. Also i cannot find any warranty information in the box whatsoever

i called amazon and they said they would issue a refund if the motherboard dosent work. But considering i ordered it new i'm a little ticked off

If it doesn't work, go and return the motherboard. If it works, you should have nothing to worry about.

yah warranty still stands. you can call Gygabite and tell them to RMA your board or if it has been like 20 days that you have the board you can call Amazon and get the board replaced

What I mean is, does the warranty have the full length or just a small amount of time left.

depends on what they give you. some motherboards are lifetime limited and some are 2 or 3 years. you should be able to check in amazon.com

I think it might be a new mobo cause I found everything that was supposed to be in the box including a sticker the static bag was damaged but not torn so probably happened in shipping.
