If you don't have either card, and if money is of no concern, then the 970 would be the better bet. There's no real point in buying an older model of card unless you simply can't afford it.
If you are open to Radeon cards, I would recommend the 390, as it tends to be slightly cheaper than the 970 and has 8gb vram. The performance for both is similar, though at stock clocks the 390 edges out the 970 slightly.

Oh right, thanks, I already habe a 780 but was thinking about swaping for more VRAM (780 has 3GB), more futerproof and hopefully a higher fps.

Keep on mind though, rough core power on both 970 and 390 is equiel and optimized for 4gb VRAM. What I'm saying extra 4gb vram might not be problem in first place if game is using 100% card and start throttling. Same thing as 980ti and Titan. If you aim for higher resolutions then 1080p then 390x perhaps. Otherwise Nvidia should be better especially with recent releases where Nvidia performed better.

On Ebay I don't understand why I can sell my 780 used for more than it is to buy a new 970 if the 970 is said to be better
Actually that depends on the base price the manufacturer set. Like same cards from different manufacturers can have a lot of margin between them. And the 780 and 970 are pretty much same in performance with the 970 excelling in many newer titles and beating the 780 in benchmarks.
+1 I bought one brand new from overclockers a few months back for £145+vat. I wouldnt change from a 780 to a 970 though, barely any difference in performance.
