i have pirated windows 8.1 and i want legit W10

i have pirated copy of windows 8.1 and i want to upgrade to legit windows 10 without losing my data, what's the best way to do it ? should i upgrade to windows 10 then activate it? or should i buy windows 8.1 activation key then upgrade to windows 10? or is there any other way to do it?

I can tell you to activate it, but otherwise... you do know that it doesn't erase data on your drive....
