it will mainly be used for gaming. i am fine with it being able to play games on low settings (games like the total war games is what i would like to play, fallout as well)
i just dont know which will be better for the price desktop or laptop
my budget is $500 or if im lucky up to $525 not much more than that.
I would like to know the prices for them both with and without windows.
thank you for time in helping with this

Intel i5 2500K around 140$
Nvidia GTX 560Ti around 160$
ASUS H61M-C around 70$
8GB DDR3 RAM around 70-80$ (sometimes lesser)
HDD 500GB around 50-60$ (depends on seller)
Total price around 500$
If you can go up to 525$ , get basic peripherals . no need for anything fancy at all. Power supply and other stuff will be covered in less that 40$
If you still find that you need lesser cost then cut down from 8GB RAM to 4/6 GB RAM or smaller HDD.
The motherboard is not an optimal choice but it will work and fits well in your price range.

P.S These are the maximum internet prices I've given. You can get it easily for lesser money from your local stores probably. In that way you can afford all of this with Win 7 Home 64-bit within 520$ easily.

well if u want something more mobile and dont care for graphical quality in gaming then maybe u could go with laptop but if want a gaming rig go with desktop ofc because if we gonna give an example for the performance of hardware and compare between the 2 of them and gonna take the same gpu in both as an example, the desktop wins here this is the 7850 in laptops http://j.gs/32pi and here is the 7850 used for desktops http://j.gs/32pk see the difference between them ull know what i mean, and here is another solved thread with the same issue that may help u http://q.gs/52pSq

i looked at a few other posts before posting this and i found this site http://www.cyberpowerpc.com/system/LAN_III_Mini-A i was wondering if this is a good enough site to buy from or if it is to "risky" i am also wondering about the mini towers which is in the link from what i read in the link given by Hozhoz (thanks for that too) a mini is more or less the halfway mark between desktop and laptop.
the one in the link does go a good deal ( about $75.00 for ups ground delivery bringing it up to about $540) over budget but if it is the best for my current needs then i will see what can be done
