Upload and download speed on internet is not consistent and ranges from 29.23-1.91 to zero on both. Computer problem or internet problem? Time-Warner server provider thinks it's my computer.

Are you testing with a single site or just a general range? Run some speed tests from www.dslreports.com, a few times over a few hours to get an average and see what you get. If you have a router, you may want to bypass it at first and connect right to the modem, and try the tests again with the router in use. To rule out your PC, you can do the tests with another computer as well.
