Is the heat-sink oriented correctly? What model heatsink?
Anyway - heat-sink barely touching ram heat spreader is not a problem.
You'll have problems, when ram needs to be removed. Because it doesn't seem possible without removing heat-sink first.
Oh yeah, you should be completely fine as long as the heatsink isn't pushing on the ram too hard. The heatsink on the ram is nonconductive and should make it impossible to damage the ram.
And how is fan on the heat sink oriented?The way my case is setup is air blowing out from the back of the case.

Because, if you put heat sink this way, fan needs to be flipped for air-flow to go out of the case in the back.
(thermalright sticker would be on the inside)
