Lawsuit Filed Against Sega, Gearbox for False Advertising

I haven't played A:CM, but I have played Borderlands and Borderlands 2, and both those game are excellent games. Are they perfect? No, but no game is, and Borderlands 2 was everything I hoped for. There are a few little things that were promised that didn't get delivered, like increased storage space over what BL1 had, but everything else is great.
Randy Pitchford, well, he's like a kid in a candy store when it comes to Gearbox games, and I do think he gets a little over-excited when he's getting interviewed, and says some things that may be what he envisions, but isn't what the people that manage the nuts and bolts of the game are doing. There does seem to be some kind of communication gap there, and I think Gearbox and Randy should work on that; he is, after all, the CEO and president of Gearbox.
If GBX is guilty of delivering significantly less than they actually said they would, then they should refund the money of gamers who want a refund, and possibly pay a fine, but if it turns out some 80% of the people that bought it like it and play it, well, I think the others are going to have a tough sell in a lawsuit. And, frankly, there are a lot of whiners and criers out there that think everyone else on the planet should butter their toast for them, and for free. I have no sympathy at all for that kind of "gamer".
 
I really hope this just gets thrown out before it even get to court. Just another useless lawsuit taking money from game development in order to fight a stupid lawsuit that should have never came about in the first place.
Games change all the time and it is not the first time a game has not quite been the same at retail as it was in the demo. I can remember games that had levels in playable demo's that were not even in the final product. I remember movie trailers that had parts in it that never maid it into the final movie. It is just some stupid moron trying to get money for absolutely nothing period.
 
IF after all these years consumers will go and mindlessly buy a game prior to either testing it (by legal or illegal means) or reading previews and reviews of the game then I personally feel they get what they deserve.
There is a toilet paper looooong list of games that in the past 5 years (or more) have been released prematurely, in a very bad state, they are not even close to what they have preadvertised, still people can't wait.
The gaming industry is another literal meaning of what the word industry has come to mean. Mass selling with no regard for the consumer.
 
It's much easier to get your money back or some kind of resolution from a fast food restaurant than a software company. They cry piracy while they take your money and run. I hope they lose this case. It might make a better industry.
 
Are you really this naive? Do you really believe:
