[SOLVED] Migrate OS only

Hello, trying to migrate os over to an SSD but its telling me theres not enough space, I'm guessing its because the origin hdd wasnt partitioned properly and it sees the whole thing rather than just the os? If so how do I go about it, fresh install isnt an option as I dont have a copy of windows or key.
Any help much appreciated!

Options:

Assuming yours is a valid Win 7 license, discover the license key. Belarc Advisor can probably do this.
Then, download the Win 7 ISO from Microsoft.
https://www.microsoft.com/en-us/software-download/windows7
Create your own DVD or USB, and clean install on the new SSD.
This requires a clean install of all your applications.

or

Again, assuming a valid Win 7 license, Upgrade it to Win 10.
Once it is activated with Win 10, you can do a clean Win 10 install on the SSD.
And again, this involves a clean install of all your applications.

There is no tool or function to migrate "only the OS".
Whole partition or drive, yes.

What OS?
Where did it come from?
What size/make/model drives are these?

its windows 7 64bit, my old flatmate had the disc and let me install it years ago
the current hdd is a 1tb hitachi hds721010cla and the new ssd is a 240gb kingston sv300537a24

So I'm being a bit optimistic about migrating then aye?
